Tenancy agreement — home
This is a convenience translation; the Swedish template is the one to use for a Swedish transaction.
This tenancy agreement ("the Agreement") was drawn up on [DATUM] between the parties named below concerning the letting of a home. The Agreement supplements the provisions of chapter 12 of jordabalken (the Land Code), which apply insofar as the parties have not agreed otherwise within the scope of the law.
Fill in all fields in square brackets before signing. Strike through anything that does not apply.
1. Parties

Landlord and tenant are jointly referred to as "the Parties" and individually as a "Party".
2. Let object
The landlord lets and the tenant rents the following home:

3. Rent and payment
The tenant pays rent of [X XXX] kronor per month ([belopp i ord]).
Rent is paid in advance no later than the [X:e] of each month to the landlord’s bank account [Clearingnummer-kontonummer] or by another agreed payment method.
The rent includes: [Värme / Vatten / El / Internet / Parkering / Annat: _____]. The rent does not include: [El / Värme / Hushållsel / Internet / Annat: _____].
In the event of late payment, default interest accrues under räntelagen (the Interest Act) from the due date.
4. Tenancy period and notice

For a fixed-term tenancy the Agreement ends automatically at the end of the term without separate notice, unless the parties have agreed in writing on an extension.
For an open-ended tenancy the notice period under chapter 12 of jordabalken applies, unless a longer period has been agreed in writing: [X månader] for the tenant and [X månader] for the landlord.
Notice shall be given in writing and reach the other party no later than the last day of the notice month.
5. Move-in and inspection
The tenant takes possession of the home on [DATUM] at [XX:XX], unless the parties have agreed otherwise.
At move-in a joint review of the home’s condition is carried out. Any existing damage, scratches or defects are noted in a move-in protocol signed by both parties.
The landlord hands over keys, any tags/fobs and instructions for electricity, heating and waste handling.
Meters for electricity, water and any district heating are read at move-in and recorded in a protocol.
6. Use and care
The tenant shall treat the home with care and follow applicable house rules, building rules and any association statutes.
The home may only be used as a dwelling for the tenant and the following persons: [Namn/antal personer, t.ex. "hyresgästen och två minderåriga barn"].
Subletting or assignment of the hyresrätt (rented flat) requires written approval from the landlord [and where applicable from hyresnämnden (the rent tribunal) under chapter 12 of jordabalken].

7. Maintenance and repairs
The landlord is responsible for the external and internal maintenance that follows from chapter 12 of jordabalken, unless otherwise agreed in writing within the scope of the law.
The tenant is responsible for looking after the home and shall without delay report damage or defects to the landlord.
The tenant compensates for damage caused by negligence, carelessness or intent by the tenant or persons for whom the tenant is responsible.
8. Deposit
The tenant pays a deposit of [X XXX] kronor no later than [DATUM / vid tillträde]. The deposit is held in the landlord’s account as security for the tenant’s obligations under the Agreement.
The deposit is repaid to the tenant no later than [X] days after move-out, after deduction for unpaid rent, damage beyond normal wear and tear or other costs under the Agreement.
Strike through this entire section if no deposit is to be taken.
9. Insurance
The tenant shall take out and maintain valid home contents insurance covering damage in the home during the tenancy.
The landlord is responsible for property insurance under applicable rules, unless otherwise agreed.
10. Other provisions
Amendments and additions to the Agreement shall be in writing and signed by both Parties.
Disputes arising from the Agreement shall in the first instance be resolved by negotiation. The tenant may turn to Hyresnämnden (the rent tribunal) in the locality where the home is situated for review under the Tenancy Act.
Personal data are processed only to perform the Agreement and under applicable data protection legislation.
11. Signatures
The Parties confirm that they have read and understood the Agreement, that the particulars are correct to the best of their knowledge and that they sign the Agreement voluntarily.

Where there are several tenants each person signs separately. For subletting, approval from the primary landlord/hyresnämnden should be available if needed.
